  • ACU-OER operates and offers Open Educational Recourses(OER) and Learning Management Systems(LMS), with aim of expanding higher educational opportunities in ASEAN and to strengthen cooperation between ROK and ASEAN universities.

  • Purpose
  • The ACU-OER’s contents and services are provided by the ACU Secretariat at the Korea Education and Research Information Service (KERIS). Please read these Terms of Service (hereinafter referred to as the “Terms”) and the ACU-OER Privacy Policy prior to registering at www.aseanoer.net or using any portion of the ACU-OER Website (the “Website,” which consists of all content and pages located within the www.aseanoer.net web domain). You may get access to the Website, including access to any learning materials, bulletin boards, or other electronic “Services”. As some of our Services may be software that is downloaded to your computers, phones, tablets, or other devices, by using our services you agree that we may automatically update this software, and that these Terms will apply to such updates. These Terms and the Privacy Policy are agreements (hereinafter referred to as The “Agreements”) between you(the user) and the ACU-OER Secretariat. By using our Services, you agree to be bound by these Terms, including the Privacy Policy, whether or not you are a registered user. If you do not understand or do not agree to be bound by the terms of the Agreements, you should not use the Website.
  • Effect and Modification of the Terms
  • These Terms will be effective from the date that the ACU-OER Secretariat posts them on the website. ACU-OER reserves the right, at our discretion, to change, modify, add, or remove portions of the Terms at any time. In that case, we will post the updated Terms, as relevant, to the applicable Website and indicate the date of revision. In addition, if drastic modifications are made, we may display a notice on the Website indicating that the Terms have changed. All new and/or amended Terms take effect immediately. Therefore, we encourage you to periodically review the Terms throughout your continued use of the Website visiting and using the website constitutes your binding acceptance of such changes. If you do not agree to the modified Terms, you may stop using the Services and withdraw. Disputes arising under these Terms will be resolved in accordance with the version of the Terms in place at the time the dispute arose.
  • Regulations other than the Terms
  • When any matters not specified in these Terms are specified in relevant laws and regulations, they shall be governed by the relevant laws and regulations, the governing laws and regulations shall take precedence.
  • Definition of Terms
  • Major terms used in the ACU-OER’s Terms of Service are defined as follows:
    • a. Services All services related to online learning provided by ACU-OER
    • b. Website ACU-OER, LMS homepages and CMS homepages, which consist of all content and pages located within the www.aseanoer.net web domain
    • c. User Any person who agrees to these Terms by logging in and/or registering his/her user account at the ACU-OER Website by providing his/her personal information and who is authorized to use the services provided by ACT
    • d. Service Use Agreements All agreements, including these Terms, entered between ACU-OER and its members related to the use of services
    • e. Password A combination of unique characters and numbers that the member sets up for user authentication
    • f. Withdrawal Termination of the service use agreements by ACU-OER or by the member
  • Any term that is not defined above in these Terms may follow related laws and guides on each Website, or otherwise comply with customary practices.
  • Establishment and Termination of Service Agreements
  • Member registration is established by the applicant’s completely filling out the application form to meet the registration requirements. All members must provide their personal information to use the advanced Services. Any member who has not registered his/her true and authentic information through illegal use of other person’s information or registration of false information cannot claim any rights with regard to the Services use and may be punished in accordance with related laws and regulations.
  • ACU-OER may cancel membership registration in the following cases:
    • a. where a person applied for membership using another person’s name;
    • b. where a person filled out the application form or applied for membership registration with false information;
    • c. where a person applied for membership to disturb the peace and order of society or cause harm good customs;
    • d. where a person committed an act of interrupting other person’s service use on the Website or of making fraudulent use of other another person’s information;
    • e. where using the Website, a person committed an act that is prohibited by laws or the Terms;
    • f. If a person fails to meet other membership registration requirements set by the Website.
  • If a member wants to cancel service use Agreements, the member should withdraw his/her membership.
  • User Account Registration and Withdrawal
  • • While any visitor can view the Website, you must select a registered user means identification (through Facebook or Google account) and a user password that is unique and entirely different from your selected account (Facebook or Google account) in order to use the ACU Services. By proceeding with user registration, you automatically agree that you will never divulge or share access information on your Social ID and password with any third party for any reason. If you do not agree, you may not use the ACU-OER Services. You must provide your name, an email address, a user password, etc. in order to become a registered user. You must also agree to maintain and update your information to keep it accurate and current. We care about the confidentiality and security of your personal information and please see our Privacy Policy for more details surrounding what types of personal information ACU-OER collects and how ACU-OER uses that information. You may cancel the Terms at any time by deleting your login account with the Website and discontinuing your use of any and all parts of the Website.
  • Privacy Policy
  • Your privacy is important to ACU-OER. Please read the ACU-OER Privacy Policy carefully for information related to ACU-OER’s collection, use, and disclosure of your personal information. We care about the security of our users and even though we work to protect the security of your account and related information, ACU-OER cannot guarantee that unauthorized third parties will not be able to breach our security measures. Please notify us immediately of any compromise or unauthorized use of your account by emailing acu_cloud@keris.or.kr.
  • Provision of the Website and Services
  • You may only use the Website and Services in accordance with these Terms. In particular but without limitation, you may not use the Website and Services for any purpose that is unlawful or prohibited by these Terms, or any other conditions or notices that are made available on the ACU-OER Website or Services.
  • Modification and Termination of our Services
  • We are constantly changing and improving our Services. We may add or remove functions, or change requirements for users. Also, we may suspend or halt access a Service altogether. Accordingly, ACU-OER may terminate your use of any Services for any reason or lack thereof. None of ACU-OER, its participating institutions and other agents shall have any liability to you for any such action. You can stop using the Services at any time.
  • Termination of Rights
  • You agree that ACU-OER, at its sole discretion, may deactivate your account or otherwise terminate your use of Services for any reason or no reason, including, without limitation, if ACU-OER believes that you have (a) breached these Terms, (b) infringed on the intellectual property rights of a third party, (c) posted, uploaded or transmitted unauthorized content to the LMS or bulletin board or (d) violated or acted inconsistently with the letter or spirit of these Terms or any applicable code of conduct. You also acknowledge that ACU-OER may retain and store your information on ACU-OER’s systems notwithstanding any termination of your account.
  • Proprietary Materials: Trademarks
  • This Website is owned and operated by ACU-OER. The visual interfaces, graphics, design, compilation, information, computer code (including source code or object code), software, services, content educational videos and exercises, and all other elements of the Website (the “Website Materials”) are protected. All Website materials, all trademarks, service marks, and trade names contained in or available through the Website are owned by or licensed to ACU-OER, and ACU-OER reserves all right, therein and thereto, not expressly granted by the Terms.
  • Copyrights
  • ACU-OER may make available on the Website certain educational videos, exercises, and related supplementary materials that are owned by ACU-OER or its participating licensors (the “Licensed Educational Content”). ACU-OER grants to you a non-exclusive, non-transferable right to access and use the Licensed Educational Content as made available on the Website by ACU-OER solely for your personal, non-commercial purposes. Unless expressly indicated on the Website that a particular item of Licensed Educational Content is made available to users under alternate license terms, you may not download, distribute, sell, lease, modify, or otherwise provide access to the Licensed Educational Content to any third party.
  • ACU-OER’s Obligations
  • ACU-OER will faithfully abide by related laws, and exercise its rights and perform its obligations in good faith in accordance with these Terms. To do so, ACU-OER shall establish a security system to protect personal information so members can use services, and so that users can be notified of the Policy. Except for cases expressed otherwise in the Terms and Privacy Policy, ACU-OER shall take due care not to disclose or provide the member’s personal information to a third party. Also, ACU-OER shall make its best effort to repair or restore the equipment without delay if the equipment fails or any data is lost during service improvement so that continued and stable services can be provided. The only acceptations to this would be due to unavoidable circumstances, natural disasters, emergencies, defects, failures, etc. that cannot be resolved by current technology.
  • Member’s Obligations
  • The following list of acts is strictly prohibited on the Website:
    • a. act of using other member’s ID and password illegally;
    • b. act of duplicating the information that is collected from services, of using the information for publishing, broadcasting, etc., or of providing the information to a third party without prior consent from ACU-OER for purposes other than originally agreed-upon use;
    • c. act of infringing on other rights, including copyrights;
    • d. act of distributing any information or contents to other parties, including sentences, figures, etc. that go against public order and good customs;
    • e. act that is objectively deemed connected with crimes;
    • f. act that goes against other related laws and regulations;
    • g. act of using the ACU-OER services for commercial activity. If the commercial activity causes any damage, you are liable and may have to provide compensation for any damages.
  • Responsibility
  • ACU-OER shall not be liable for any damages incurred to you in connection with the use of the Services unless there is intentional or gross negligence of the Website.
  • Disclaimers
  • If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the other provisions herein, and shall not affect the validity and enforceability of any remaining provisions. ACU-OER shall have no liability under these Terms to the extent arising from any failure of ACU-OER to perform any of its obligations within, for reasons due to natural disaster, war, civil unrest, terrorism, Internet failures, governmental acts or court orders, national emergency, strikes or labor disputes or any other event not within ACU-OER’s reasonable control. ACU-OER shall not be responsible for damage or other problems caused by any unauthorized change to these Terms caused by hacking.
  • Any delay or failure on the part of ACU-OER to enforce any rights under these Terms to which it may be entitled shall not, in any event, be construed as a waiver of the right and privilege to do so at any subsequent time.
  • Governing Law and Jurisdiction
  • The court having jurisdiction over the location of the ACU-OER or the court under the civil procedure law of the Republic of Korea shall preside over related legal matters The laws of the Republic of Korea shall apply to the interpretation and application of these Terms and the settlement of any dispute related to these Terms and Conditions.
